Trying to build a garage that is 20'x 50' on 1/2 acre lot.
Planning commission shot down project as too large. We live in an environmentally sensitive area. It will not obstruct any views, and it will be the first phase of a complete house remodel. Hate to have to hire a lawyer, any property rights advocacy would be greatly appreciated(ie what's my next step) |

Is it your lot? Is it in a resedential or business area? I say build it. Dont bother with regulations. If its your property, then you can do what ever the heck you want.

I'm interested in this subject because I wish to build a second garage on my lot. The
neighborhood covenants don't allow the neighbors back road access but the neglected my lot. If I file for permits they will be rejected, but it's an oversight that I would like to take advantage of. What would be the best route to take without the burden of legal fees? |

You aren't sunk yet...my father used to be a county manager for the wetlands/runoff part of the review process, so having had exposure to all kinds of things coming through like yours (from sheds to 500 unit apartment buildings), my advice is this: remember, everything in life is NEGOTIABLE. Yes, get a lawyer. But don't rush up and threaten to sue the state/county, their family, thier parents, and their dog. It will only piss them off. Review plans. Maybe consult an engineering firm, and then go back firmly and talk to the state/county and see what needs to be done so you can build it. Maybe a small change needs to be made, like shortening it or moving it slightly on the property, and it'll go through. Talk to a couple of different people there, and make sure they are not the front desk staff! Try to get a manager to discuss it with you. However, be very nice to the front desk staff, or you won't get anywhere. Be nice through the whole process. I can't tell you how many times I would stop by to see my father at work, and he would be standing there with somebody threating to kill him (honestly) because they couldn't put in something on their property.

Some suggestions that have worked for some people I know.Find out the maximum dimensions allowed and build the inside of your garage to those spec's.Find out maximum height.Enough height to stack cars?.Ask your neighbors to back you up and help you get a variance to the dimensions you want.If the neighbors are against you you are screwed.Add a shed to the back of the garage when you pour the pad.You may get away with a shed attached to your garage.If not,you have a garage patio(carport). Sorry about that. It was a cheap and easy shot and I took it anyway. The only crime you are guilty of is wasting our server's space and my time. Quite frankly you post here more than all the other non-owners combined. Surely there is somewhere else you can go play... Brett, I suspect that in your haste to get your concrete poured you may have mistaken me for someone else. While I have been known to drive non-domestic vehicles of both the 2 and 4 wheeled variety on occasion, I can assure you that there is no way you could have been blocking me at Buttonwillow. First of all this would assUme that you were actually in front of me, and we all know what a perennial back marker you are. But more importantly I have never been anywhere near Buttonwillow. In fact sir, I don't even know where the bloody track is... |

Don't worry about Woody, he is probably just cranky about his poor quarter mile time, judging from his signature . Actually a lot of people in my neighborhood just build without permits but I suspect that now that the process is started that is not an option. It is all about who you know. Ask your friends if any know someone in the local planning office. Good luck. |
