    Default Justice Scalia Passes Away

    An awful thing happened last night. Justice Scalia passed away in his sleep.

    I doubt that in this election year that he will be replaced. His death throws the 5/4 conservative leaning in the Supreme Court out of balance. Some will welcome that but if you are a believer in the view that the Constitution should be read as originally written and not as someone would like it to be rewritten: and, that the Constitutional Amendment process contained within the Constitution should be used as opposed to stretching words beyond their intended meaning, it is a sad, sad day.

    Last April, at The United States Tax Court Judicial Conference, where Justice Scalia was a dinner speaker, I had the privilege of having a drink with Justice Scalia and speaking with him for about fifteen minutes or so. He was an incredibly quick, charming person. Very down to earth. Funny at times. He said what he meant and meant what he said. The kind of person you want on your side when it hits the fan. 79 years old. Nine children. 28 grand children. He will be greatly missed. Below is a photo taken by another attendee at the Conference when we were chatting.

    Yes. A nomination can be held up until a new President is elected and I am sure it will be. And if it were a Democrat controlled Senate with a Republican President with an election coming up, they would do the same thing. Anyone who says differently is full of it.

    Obama could appoint a new justice when the Senate is in recess.

    Prior to the Supreme Court's 2014 decision in National Labor Relations Board V. Noel Canning, that gambit was tried. After this decision, it is easy for the Senate to prevent the use of same. Also, remember that such an appointment is temporary. Obama is a self proclaimed Constitutional scholar. If he nominates someone in the face of the Canning decision, it would be a spiteful act which he knows will only result in further divisiveness and rancor in our country without getting someone on the Court. Of course, unless that someone is acceptable to all. Obama's favorite for the position, Sri Srinivasan, is not acceptable to all. But, I expect Obama to nominate someone unacceptable to all since he has never put our country above his own ego.

    That article is insightful. Obama may appoint someone and let the chips fall where they may. He's never let the constitution stand in his way before, so why now.

    Yep. I'm sure it won't be without its antics though.
